The Six Cities of Refuge Shall Be Levitical Cities
Numbers 35 assigns 48 cities to the Levites (Numbers 35:7) distributed across all the tribal territories. Of these 48, six are designated as the cities of refuge. The commandment here is that the communities of Israel ensure these six Levitical cities are set apart and maintained as refuge cities. A Levite who kills accidentally faces a distinctive situation: every Levitical city is his home territory, but only the six designated refuge cities provide legal protection. He must go to one of the six, not merely any Levitical city.
Forty-Eight Cities for the Levites, Six for Refuge
Numbers 35:1–8 establishes the full system: the Levites receive no tribal territory but 48 cities distributed among the tribes, with surrounding pasture. From these 48, six are designated as the refuge cities — the same six Joshua will later name (Joshua 20). Why Levitical cities? The Talmud (Makkot 10a) notes that the Levites' dispersal across all Israel meant they were accessible throughout the land. More significantly: the Levites were the custodians of Torah and justice (Deuteronomy 33:10: “they shall teach Jacob your rules and Israel your law”). A city administered by Torah teachers was the appropriate context for administering the mercy of the refuge system.
The Levite Who Kills: A Special Case
The Talmud (Makkot 10a) raises a distinctive question: what happens when a Levite accidentally kills someone? The Levite's entire territory is Levitical cities — he lives in one of the 48. Can he simply remain in his own home city? The ruling is no: he must go to one of the six specifically designated refuge cities. Even though every Levitical city is technically his home, only the six formal refuge cities provide legal protection from the avenger of blood. The designation of the six as distinct from the other 42 creates a formal legal status: Levitical cities qua residence are different from Levitical cities qua refuge. The formality of the designation matters.
Numbers 35:13: “of these cities that you give to the Levites, you shall designate six as cities of refuge.” The word “designate” (titnu) confirms that the six must be formally set apart.
